The Federal Court has this week heard closing submissions by counsel for Apple in response to antitrust claims brought against it (and against Google) by Epic Games (and two class action applicants) concerning the terms under which app developers and app users transact with the App Store (and the Google Play store). It marks the end of a 16 week trial as well as 30 months of HoustonKemp assistance to Apple, in preparing for expert evidence given by Greg Houston, with monumental support from Luke Wainscoat, Nick Twort, Adam Evans and Liam Hickey. The proceedings featured 10 economic experts, drawn from five different countries, with Greg Houston’s evidence spanning market definition, market power, competitive effects of the alleged App Store restrictions, and the likely state of competition in a counterfactual without the restrictions. Epic indeed!
